How does Mediation Work to Resolve Disputes?
Through confidential sessions with a qualified, impartial Mediator, mediation helps participants explore options and settle disputes creatively and fairly, via facillitated, structured and safe confidential conversation; where your voice is heard.
What is so different about mediation is that we can 'throw out' the legal rule book. So there is not a 'winner' and a 'loser'. Courts are restricted by the law. There can be no nuance. No understanding. No mutual agreement. No apology. Or any creative solutions.
Anything going to Court, when it is finally heard, is Public Record. Mediation is, in it's entirety, confidential.
Read more below how Mediation might be the right path for you to pursue.
Strict Confidentiality and Impartiality
Each mediation session is held under strict confidentiality guidelines. The Mediator remains neutral and impartial, providing a safe environment where all participants can openly discuss the situation without fear of any external exposure.
Each part of the Mediation is confidential. Nothing you share with the Mediator in private will ever be communicated without your express permission.
This assists people as they are given the space and time to explain and explore the situation with no fear of Judgement.
You can genuinely say how you feel, how the situation has affected you and any other thing that becomes relevant.
You are in control.

Creative Solutions
Mediation expands resolution possibilities far beyond what the Court is limited to award. Participants can creatively tailor agreements that consider their interests and relationships, fostering sustainable outcomes rather than win-lose results. There is not a black and white solution where there is only one limited outcome. With mediation, the confidential settlement is arrived at with mutual conversation, it really has no limitations.
Cost Transparency and Value for Money
Through a clear and upfront fixed fee scheme, the costs of mediation are shared by the participants involved. This approach eliminates hidden fees and ensures no side pays for the other's legal costs, making mediation a financially fair alternative to litigation. It is also extremely cost effective by comparison to litigation.

Your time is precious.
There are long Court delays and of course the costs associated.
With mediation participants can be in control of their schedule.
It is usual for a mediation, under £50k in value to take a day or less in total.
Rather than being at the mercy of Court listings, you can decide when you want to voluntarily come together, to resolve your dispute.
The current Government Statistics (MoJ) A Claim under £10k is estimated to take 39 weeks to come to Court. For Claims of £10 - £50K the wait is 14 months!
The result of chosing mediation can be that the 'thing' that has been taking up your life, the stress, the worry, can be gone. Finished. Resolved. In a day, scheduled to happen within the next 3 weeks. With a 93% reported success rate of settlement.

Accessible for All
Mckendrick Mediation welcomes everyone, especially unrepresented individuals seeking accessible, professional dispute resolution services who may not have legal representation.
It maybe difficult to imagine coming together 'online' or 'face-to-face' with the other participant in your dispute.
This is why being a Mediator is recognised, regulated qualification.
At no point should you ever feel in a mediation that you are 'on your own', or 'bullied'. None of that is acceptable and the Mediation Agreement everyone signs up to is that they are all 'willingly and voluntarily agreeing to come together to discuss and try to find a way out of the dispute'.
Before the day, you will have had a private conversation with your Mediator and any concerns you may have, you can raise with them so they can ensure that you know you are coming to a safe space where you are equal to the other participants within the mediation. No matter if you are represented by a Solicitor or legal representative or not. You can bring along someone for support to the mediation.
Discuss any concerns you have with your Mediator ahead of your meeting.
