How Mediation Works at Mckendrick Mediation
Mckendrick Mediation offers a clear, practical pathway from first contact to a mutually agreed mediation. Our process is designed to be transparent and efficient: we explain confidentiality and costs up front, and guide parties through a facilitated process towards a confidential settlement.
Sessions are offered both in‑person and online to suit circumstances, geography and the complexity of the dispute. Throughout, our aim is to assist parties to reach a durable agreement while preserving dignity and control over the outcome.

Initial Contact and Assessment
Clear first steps to establish expectations and agree to mediate.
Contact Mckendrick Mediation by email or via the free consult call to arrange an initial conversation. During this we explain the mediator’s role, confirm that mediation is suitable for your dispute, and outline likely timescales. We also explain fees and our cancellation policy at this stage so there are no surprises. If mediation is appropriate, we agree who will attend.
Mckendrick Mediation cannot influence or convince another participant to engage in mediation. This must either be done mutually with one participant making the contact. Or if one participant has engaged, they must suggest Mckendrick Mediation to the other participant.
Once this mutual agreement via email is confirmed the Agreement to Mediate will be sent, which is signed by the particiapants to initiate the mediation.
Preparatory meetings will then be scheduled.

Preparation and Agreement to Mediate
Practical preparation
Before the mediation itself begins, Mckendrick Mediation asks for short, separate preparatory meeting online/call for each participant, in which the Mediator will set out ground rules, confidentiality terms and the voluntary nature of the process, including understanding of the signed Agreement to Mediate.
Any documents that are necessary shall be discussed in this preparataory meeting and supplied to Mckendrick Mediation in confidence ahead of the mediation in line with agreed timescales.
It is never necessary for the mediator to have a full 'Court' Bundle or a statement. Any required documents will be discussed in the preparatory meeting and should never be onorous to either participant. They will be unlikely to be used in Mediation.
This will be charged at the 1 hour rate of £75 (no VAT) per party.

Mediation Sessions: In‑Person or Online
Flexible formats to support effective outcomes
Sessions at Mckendrick Mediation are tailored to the partipants' needs. We can conduct Online video sessions or in‑person meetings.
With both of these the Mediator is managing the process, exploring options, and assisting parties to identify realistic solutions.
Legal advisers or any other supporters/advisors may attend if agreed by the participants.
Please be aware as this is a confidential process it is essential that those with authority to sign are present.
If a person who is there for support or to observe they must also agree and sign the Mediation Agreement to confirm their confidentiality.

Drafting Agreements and Follow‑Up
What happens at the end?
At the end of the mediation hours which have been contracted, there are several options.
A settlement is reached or, the Participants have come to a better understanding of the situation.
If an agreement has not been reached, it can be useful to decide to continue on the day if that is agreed and possible, or to adjourn and re-visit at another mediation session in the next few days or a date in the future.
This is the benefit of the mediation process. It is directed by you.
The cost is up-front, and from latest statistics from CEDR Mediation has a 92% success rate in reaching settlement.
The Mediator does not draft the settlement or sign it, the participants draft and sign. The contents of which remain confidential. This document is legally binding.
